Terms & conditions
Scope
These General Terms and Conditions regulate the legal relationship between you (the travel agency, Tour Operator, or traveller) and Escales Signature with regard to all travel arrangements and services provided by Escales Signature.
Passport Requirement
Full passport details are required to book flights, train tickets, or any other services. Passports must be valid at the time of travel. Entry into Morocco is not possible with an ID card alone. Foreign passport holders who do not comply will risk being denied boarding or deported upon arrival.
Visas
It is your responsibility to verify visa requirements with your embassy prior to travel. Escales Signature cannot be held responsible if the necessary visa conditions are not met. Visas must be obtained in advance, as border officials may not be able to issue them on arrival.
Travel Insurance
All travellers must hold a valid comprehensive travel insurance policy covering personal effects, accident, medical expenses, emergency evacuation, cancellation, and curtailment.
Conclusion of Contract
The contract between you and Escales Signature takes effect upon written acceptance of your booking request (by email, WhatsApp, or any other written form). From that moment, all rights and obligations arising from the contract come into force for both parties.
Booking Confirmation
A deposit of 30% of the total arrangement price is required at the time of booking confirmation. The balance is due 30 days prior to departure. If you book less than 30 days before departure, the full amount must be paid at the time of booking. Travel documents will be issued upon receipt of full payment.
Cancellation Fees
30 days or more before arrival: 30% of the total price From 21 to 30 days before arrival: 50% of the total price From 15 to 20 days before arrival: 75% of the total price Less than 15 days before arrival: 100% of the total price
Any traveller who fails to appear at departure, arrives too late, or lacks the necessary travel documents will be charged 100% of the trip price. Peak season cancellation policies may be stricter and are available upon request at the time of quotation. Third-party suppliers may also apply their own cancellation policies, which may require higher upfront deposits.
Changes to Program or Price
Escales Signature reserves the right to modify brochure information and prices prior to booking. After contract conclusion, price adjustments may occur due to transport cost increases, new taxes or official fees, exchange rate changes, or government-imposed measures. Any increase will be communicated no later than 22 days before departure. If the increase exceeds 10%, you may accept the change, cancel with a full refund within 5 days, or opt for an alternative trip of equivalent value.
Cancellation by Escales Signature
Escales Signature may cancel a trip due to conduct attributable to the participant, insufficient participant numbers (with notice given at least 15 days before departure), or force majeure events such as natural disasters, epidemics, or strikes. In all such cases, the amount already paid will be refunded or applied to an alternative trip of equivalent value.
Early Termination
If you interrupt your trip for any reason, no refund will be issued for the remaining arrangements. In cases of emergency (illness, accident, or serious family bereavement), your travel insurance policy should cover the applicable costs.
Liability
Escales Signature assumes no liability for non-performance or improper performance of the contract resulting from the traveller’s own negligence, unforeseeable acts of third parties unrelated to the contracted services, or force majeure events that could not have been foreseen or prevented. The total liability of Escales Signature is limited to the maximum price of the trip.
Activities and Excursions
Some activities included in the trip may carry inherent risks depending on the traveller’s fitness or health condition, including but not limited to trekking, camel rides, quad biking, surfing, kite-surfing, desert safaris, sidecar rides, and hot air balloon flights. Participation in such activities is entirely at the traveller’s discretion and responsibility.
Claims
Any issue or defect must be reported immediately to Escales Signature during the trip. Written confirmation of the reported problem should be obtained on-site. Any formal complaint or request for compensation must be submitted in writing to Escales Signature within 30 days of return, accompanied by the written record obtained during the trip.
Applicable Law and Legal Venue
All contracts between you and Escales Signature are governed by Moroccan law. Any disputes shall be settled exclusively before the courts of Marrakech.
